Foreign Company/ Foreign Branch

A foreign company (also known as Foreign Branch) is a company incorporated outside Malaysia. It is an extension of the foreign parent company and is not a separate legal entity in Malaysia. Therefore, a Foreign Branch is required to conduct the same business activities as the parent company. In addition, in the case of a lawsuit or other legal disputes, a branch’s liability may extend to the issued capital of the foreign company.

Other notable distinction is, a Foreign Branch is treated as a non-resident for tax purposes. The Foreign Branch is taxed on income derived from Malaysia.
